The buyer who places an order for our products on the website “Rosemary Creek” admits to know our terms and conditions. Placing an order on this website and confirm an order implies full acceptance of these terms and conditions of sale.

The buyer has the option, if desired, to save or print these terms and conditions.

Article 1: Acceptance and Wholeness

These conditions reflect the obligations of the seller and the buyer. The buyer agrees without reservation all of these conditions. Neither the buyer nor the seller can not change these conditions once accepted by the buyer.

Article 2: Purpose

The purpose of these terms and conditions is to define the rights and duties of the buyer and seller.

Article 3: Obligations between the buyer and the seller.

3-1: Rosemary Creek LLC bonds:
For all orders placed on this website, Rosemary Creek LLC agrees to sell and to deliver to the buyer the goods ordered.

3-2: Duties of the buyer: 
The buyer agrees to provide all information necessary for delivery, and especially an address where delivery can be made during business hours. The buyer also agrees to make payment on the order.

Section 4: Contract of sale

The contract is formed by the following documents: terms and conditions and the order form. If these documents are in conflict, it is the terms and conditions prevail.

The sale is in accordance with the distance selling regulations of French law.

Article 5: Validity of contract

These terms and conditions shall take effect upon confirmation of order. They are only valid for the duration necessary for the provision of goods and services purchased.

Article 6: Electronic Signature

The click of the buyer on the button "I confirm my order", after choosing the means of payment, constitutes an electronic signature. The signing between the parties has the same value as a handwritten signature.

Article 7: Rights and validity

Only the French and European laws shall apply between Rosemary Creek LLC and buyers. 
If one or several clauses from these terms and conditions have become invalid or declared by the law to have been changed, all others will remain valid.

Article 8: Amicable solution

In case of any problem, the buyer should contact in priority , via email to obtain a friendly solution.

Article 9: Delivery deadline

Rosemary Creek LLC has to respect a deadline for delivery, if beyond delivery date, the customer may go to the website www.rosemarycreek.com and request a full refund of his order including shipping charges. However it is the responsibility of the customer to pay shipping and handling for cancelled orders.

Article 10: Personal data protection

Information is requested from the buyer is required to process the order and may be used by the partners of Rosemary Creek LLC for the execution of the order. 
The buyer may at any time write to Rosemary Creek LLC, using the website "Contact us" section, in exercising his or her rights to access, review, correct or delete information about him or her.

Article 11: Order Confirmation

Upon confirmation of purchase by the buyer on the website www.rosemarycreek.com, the seller will confirm the ordered items and the conditions chosen by the buyer by sending an email. Confirmation by email is prefered for reasons of speed and ecology.

Article 12: Payment

Rosemary Creek LLC accepts several means of payment: credit card, debit card, check, bank transfer and cash on delivery. 
Payment by credit card is the easiest, because it is immediate.
Payments by check or by bank transfers take longer to process. Rosemary Creek LLC has to wait for the confirmation from the bank before sending the order. 
For cash on delivery, the payment is made on delivery. 
Buyer warrants that it has permissions to use the means of payment chosen by himself or herself, when validating the order. 
Rosemary Creek LLC reserves itself the right to suspend any order in case of non payment or in case of payment dispute. 
Rosemary Creek LLC strives to ship orders within 3 days after payment confirmation.

Article 13: Product Information

13-1: Rosemary Creek LLC strives to present on its website detailed information on products. The goal is to provide as much information as possible to the buyer for his purchase.

13-2: Pack and promotional offers made by Rosemary Creek LLC are valid only depending on the availability in stock.

Article 14: Prices

All prices are quoted in euros. 
The price on each product does not include shipping and handling. The total amount of the transaction, containing the prices, taxes and shipping and handling is stated to the buyer before the confirmation and will not change after the order has been confirm. 
Prices take in consideration the VAT applicable on the day of the purchase.

Article 15: Invoice

An invoice is included with each delivered order.

Article 16: Out of stock

In case of stock shortage of ordered products, the buyer will be informed as soon as possible and will be able to cancel his/her order. The buyer will then have the choice of requesting either a refund or exchange the product.

Article 17: Shipping & Delivery

All packages sent are protected so that they reach you in the best condition. 
Products are delivered to the address indicated by the buyer upon his/her purchase. At the delivery, the buyer should check the condition of products and of the packaging. The buyer must report any damage to the carrier on the delivery, and inform Rosemary Creek LLC within a week. Above all, the buyer should not refuse delivery. 
The buyer can receive the invoice to an address and the delivery to another one. Just enable the option provided for this purpose on the order form. Regarding shipping, we mainly work with La Poste.
Rosemary Creek LLC endeavour to ship the products within 3 working days. However, delivery times are non contractual. Rosemary Creek LLC can not be held responsible for a longer duration of delivery in case of loss or strikes.

Article 18: Anomalies in delivery due to carrier

If the buyer finds a problem regarding the order delivered (damage, missing product compared to the delivery order, damaged parcel, broken product ...) should be indicated on the delivery, with his signature. Thereafter it shall inform the Customer Service of Rosemary Creek LLC. Rosemary Creek LLC is committed to refund or replace defective products, lost or damaged.

Article 19: Error in command

In case of error in the delivery if the products delivered do not match or if they are not conform to those specified in the order, the buyer can request an exchange or refund of the products. 
The buyer has 3 days upon receiving the order to inform Rosemary Creek LLC. The easiest way to formulate the claim is to send an email via the website "Contact us" section.
In case of refund or exchange, all products to exchange must be returned to Rosemary Creek LLC in its original packaging and in perfect condition for resale. The shipment must be mailed to the following address:

Rosemary Creek LLC will be responsible for the shipping cost, unless buyer’s claim does not correspond to the statement.

Article 20: Cancelation

The buyer have 15 days to exchange or to get a refund on his/her products. Rosemary Creek LLC will ship the products to the buyer free of charge. If the15 days deadline falls on a saturday, sunday or a national holiday, it will be extended to the next business day. Products will be exchanged or refunded to the buyer on his/her request on his/her request.

Items must be returned in their original packaging, complete, intact and in perfect condition for resale. Any product that has been consumed, damaged, or whose original packaging has been damaged, will not be refunded or exchanged. 
In case of exercising the right of cancellation, Rosemary Creek LLC will make every effort to pay back the buyer within 15 days. The buyer will be refunded by check.
